DISCOUNT CODES

Discount codes or coupon codes cannot be combined with other cart-level promotions. Discount codes are limited to one per order. Some coupon codes are valid for one-time use only. 

RETURN SHIPPING

Shipping charges for any non-defective returns are the responsibility of the customer. Original shipping, duties/taxes and insurance charges are non-refundable.

ORDER CANCELLATIONS

Orders are processed and sent to our fulfillment center within 20 minutes of the order being completed. You can cancel an order at no charge if we are notified within 15 minutes. Please call us at (385) 219-4767 between Monday-Friday 8am-5pm Pacific Standard Time for immediate assistance. A $10 restocking fee will be assessed if we are notified after the 15 minute window, but before the order ships. Emails will not guarantee your order will be cancelled as they are answered in the order they are received. Orders cannot be cancelled after they ship. Special orders cannot be cancelled as the funds have already been sent to the manufacturer to secure your watch. We reserve the right to cancel and refund orders at our discretion.

LOST OR DAMAGED SHIPMENTS

Once items are shipped, liability is covered by the terms of the carrier. We will ship to the address specified by the customer. If you did not provide us with an accurate address, neither Asteriskwatches.com, nor the shipping carrier can be held responsible for the loss of an item. Please double check your shipping address. Any shipping damage must be reported to Asteriskwatches.com within 48 hours of delivery, otherwise it is ineligible for any insurance or refund claims.

The shipping charges on our site cover freight only and do not include insurance. Shipping insurance is available for all items and can be selected at checkout for a nominal charge and is non-refundable even if an item is returned. If shipping insurance is not selected at checkout , the customer assumes all financial responsibility for non-delivery by the shipping company and agrees to hold Asteriskwatches.com harmless for non-delivery and agrees not to initiate a chargeback or dispute against Asteriskwatches.com. If shipping insurance is selected, Asteriskwatches.com's shipping insurance provider will agree to replace or refund the non-delivered item in the event the shipping carrier does not deliver it within 60-90 days of shipment. In the event the shipping carrier shows the item(s) as delivered, shipping insurance does not apply unless a police report is submitted. 

DUTIES/TAXES

Tariffs, duties, taxes, handling charges etc. may be assessed by your local postal office/customs office for international orders, and are NOT included in the charge from our site and asteriskwatches.com is not responsible for these additional local charges. In the event UPS/USPS does not collect the taxes/duties owed to your local government, you authorize asteriskwatches.com to charge your original payment method for all amounts billed back to asteriskwatches.com. You may receive a separate bill for these additional charges from your local agency and this is not a reason to refuse the shipment as asteriskwatches.com has no control over these costs. Please check with your local customs office prior to placing an order to further clarify any possible fees. All refused/undeliverable orders for any reason will be charged a 20% re-stocking/re-processing fee of the total purchase price. Credit cards from outside the U.S.A may require additional verification and may delay the shipment until verification is complete. International orders can take up to 75 days to arrive due to your local countries customs delays. 

MODIFICATIONS OF THESE TERMS

Asterisk Watches reserves the right to change or update, at any time and without prior notice, this and all other documents collectively recognized as the “Terms”, and will notify users of this web site by posting such changed or updated Terms on this page. Any changes or updates will be effective immediately upon posting to this web site. Under certain circumstances we may also elect to notify you of changes or updates to our Terms by additional means, such as by sending you an e-mail.

Use and Restrictions

The features on this web site may be accessed and used only by individuals who can form legally binding contracts under applicable laws, who are 18 years of age or older, and who are not barred from using the web site under applicable laws. You acknowledge and agree that Asterisk Watches, in its sole discretion and without notice or obligation to you, may temporarily or permanently suspend or discontinue any or all access to the web site. We may change, move or delete portions of, or may add to our web site or its Contents (hereinafter defined) from time to time, and these terms cover any subsequent changes or modifications to our web site and/or its Contents. 
Other than for the purchase of merchandise from our web site, our web site and the contents of our web site (the “Contents”) are intended for personal, noncommercial use and you agree that you will not: (a) resell products purchased or make other commercial use of the products, web site or its Contents (hereinafter defined); (b) modify, reproduce, publish, transmit, distribute, display, create derivative works from, sell or participate in or exploit in any way, in whole or in part, any of the Contents, the web site, or any related software; (c) collect or use any product listings or descriptions; (d) use any data mining or similar data gathering methods from the web site; (e) use, frame or utilize framing techniques to enclose any Asterisk Watches trademark, logo or other proprietary information (including images, text, layout or design) without Asterisk Watches’s express consent; or (f) except for your use of the web site as expressly permitted in these Terms, access or attempt to access any systems or servers on which the web site is hosted or modify or alter the web site in any way. Any unauthorized use of the web site will result in you being banned in use of the web site.

Intellectual Property Rights

The web site and its Contents are protected by copyright, trademark, trade dress and other laws and Asterisk Watches owns and/or uses with permission all worldwide right, title and interest in and to the web site and its Contents. Asterisk Watches and all other trademarks appearing on the web site are trademarks of Asterisk Watches or are licensed and/or used with permission. You agree not to display or use such trademarks without Asterisk Watches’s expressed permission.

User Comments, Feedback, Postcards and Other Submissions

"Submissions" is any kind of user-generated content on the web site that was submitted by a user under the agreed methods and under the appropriate spaces. Those include, but aren't limited to, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered by you to Asterisk Watches on or by this web site or otherwise disclosed, submitted or offered in connection with your use of this web site. 
Submissions shall be and remain Asterisk Watches property. You agree to, if requested by Asterisk Watches, assign and transfer to Asterisk Watches all rights in and derived from the Submissions that you may have including without limitation, all ownership of and rights to use, sell and commercialize the intellectual property and the right to file applications to register such rights. Asterisk Watches is not under any obligation (1) to maintain any Comments in confidence; (2) to pay to you any compensation for any Comments; or (3) to respond to any user Comments. 
By making any Submission to the web site, you agree that such Submission does not violate any right of any third party, including copyright, trademark, privacy, patent or other personal or proprietary right(s). In addition, to the extent any Submission contains yours or any other person’s name, likeness, voice or biographical information (“Personal Rights”), you hereby grant and will cause such other person to grant to Asterisk Watches a transferable, non-exclusive, worldwide, royalty-free license to use such Personal Rights for any advertising or marketing of Asterisk Watches products in any medium. You agree to indemnity and hold harmless Asterisk Watches and its affiliates and their respective officers, directors and employees against any losses, liabilities, claims and expenses (including attorneys’ fees) arising out of your account, your use this web site, your Submission and any Personal Rights contained therein. 
You further agree that your Submissions to the web site does not contain libelous or otherwise unlawful, abusive or obscene material. You are and shall remain solely responsible for the content of any Submission you submit. You agree that Asterisk Watches may use and/or disclose information in your Submission consistent with the terms of the Privacy Policy.

Electronic Communications

You consent to receive electronic communications from Asterisk Watches either in the form of an e-mail set to you at the e-mail address listed on your account or by communications posted on the web site. You acknowledge and agree that any electronic communication in the form of such e-mail or posting on the web site shall satisfy any legal requirement that such communication be in writing.

Your Account

You must establish an account with Asterisk Watches in order to purchase through the web site. You are solely responsible for (i) maintaining the security of your account and password; (ii) restricting access to your account to yourself; and (iii) keeping your account email address up to-date. You are solely responsible for all activities, including but not limited to, all purchases of products on the web site and posting of Submissions, that occur under your account. 
You acknowledge and agree that Asterisk Watches may access, preserve and disclose your account information, Submissions, communications, and information relative to your use of the web site, and any other information under your account if Asterisk Watches is required to do so by law or legal process or if Asterisk Watches determines, in its sole discretion, that such action is necessary to protect the rights of Asterisk Watches, third parties and other users of the web site or for otherwise responding to your customer service inquiries.

Site Transactions

We reserve the right to request further identification for credit card processing on any order you place with us. We reserve the right to change and/or refuse any order you enter on the web site. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order; including multiple orders entered by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. In the event we change or cancel an order, we will attempt to notify you by contacting the applicable contact information provided when the order was submitted on the web site.

Any content offered or posted on this web site is subject to modification or discontinuation at any time and from time to time without notice or obligation to you. Without limiting the foregoing, Asterisk Watches reserves the right, in its sole discretion, to charge fees for the use or purchase of, or access to, any products, services or Content offered through the web site, at any time from time to time.
Asterisk Watches reserves the right to change or update these Terms, or any other of our policies or practices, at any time, and will notify users of this web site by posting such changed or updated Terms on this page. Any changes or updates will be effective immediately upon posting to this web site. Under certain circumstances we may also elect to notify you of changes or updates to our Terms by additional means, such as by sending you an e-mail.

Terms of Sale

All product sales from the web site are governed by the Returns & Exchanges policy and the Shipping Info that is posted on the web site. By ordering and/or accepting delivery of the products, you agree to be bound by said policies. The policies are subject to change without prior notice, and we put them up for review to users before any transaction.

Warranty

Your watch is internationally warranted by Asterisk Watches for one year from the date of purchase on all models with any material or workmanship defects.
This warranty does not cover:

Straps, glass or batteries.
Internal or external damage resulting from excessive wear, improper use or mishandling.
Damage resulting from service provided from an unauthorized service center.

Limitation of Liability

To the maximum extent permitted by law, Asterisk Watches and its subsidiary companies and/or any of its affiliated entities (the “Asterisk Watches”) exclude all liability for any damages (howsoever arising, including without limitation through contract, tor (including negligence), breach of statutory duty or otherwise) arising out of or in connection with your access to (or inability to access) or use of the web site and its contents. All conditions, warranties and other terms which may be implied by statute, common law or otherwise are hereby excluded to the maximum extent permitted by law. In no event shall the Asterisk Watches or their respective officers, directors, contractors, employees or agents be liable for: (i) any indirect, special, or consequential loss or damage, or (i) loss of profit, (iii) loss of business, (iv) loss of contract, or (vii) loss of data, in each case, incurred by any user in connection with the web site, any sites linked to it and any materials posted on it, even if Asterisk Watches has been previously advised of the possibility of such damage. Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury arising from our negligence, any breach of the obligations implied by applicable law, or for any fraud, or fraudulent misrepresentation or any other liability to the extent it cannot be waived or limited under applicable law.

Governing Law and Jurisdiction

This web site is hosted and operated in the United States, pursuant to United States law. By providing personal information to this web site, you understand and consent to the collection, maintenance, processing and transfer of such information in and to the United States and other countries and territories.

Invalidity

If any provision of these Terms and Conditions are held to be invalid, illegal or unenforceable in any jurisdiction, the same will not affect the effectiveness or validity in other jurisdiction or the effectiveness of any other provision herein.

Mobile Terms of Service

The Asterisk Watches mobile message service (the "Service") is operated by Asterisk Watches (“Asterisk Watches”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Asterisk Watches’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Asterisk Watches through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Asterisk Watches. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Asterisk or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Asterisk Watches mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
